Changing employer in China: the work and residence documents to revisit

When you change employers in mainland China, your work permit and your residence paperwork are two separate chains. This guide separates the official steps from the local and case-specific variables, and points to the authorities to confirm your situation.

When you change employers in mainland China, two document chains move at once: your work permit and your residence document and any linked registration. Under the cited Beijing guidance, the former employer applies to cancel the old work permit and the new employer files for a new one; the residence side has to stay consistent with your actual employment. Neither step is a single national form, and the timing figure that gets quoted most often applies only to one local scenario.

What you have to revisit

Two things, at minimum:

  • The work permit. Cancellation of the old permit and issuance of a new one are separate actions. The cancellation is filed by the employing unit — not by you personally — according to Beijing's local cancellation guide (Cancelling Work Permits in China).
  • The residence document and the recorded particulars tied to it. Your residence permit and the details linked to it must keep matching your real employment. The duty to flag a change sits with the employer, but the document status is yours to watch.

A 2025 State Council regulation puts the reporting duty plainly: when an employing unit finds that a hired foreigner has left the job or changed work region, it must report promptly to the local public security exit-entry authority at or above county level (Regulations on the Administration of the Entry and Exit of Foreigners, Article 26).

Why it is two documents, not one

The work permit authorises the job; the residence document authorises your stay. They are issued and tracked through different systems, and a change on one side does not automatically correct the other. If your residence permit was sponsored by your old employer, or if the recorded purpose of stay no longer matches your new role, that gap is a residence-side problem, not just a work-permit formality.

This is a procedural boundary, not a deadline. The supplied Beijing guidance and the national regulation both treat the work permit and the residence/registration status as items that must be kept aligned, but neither supplies a single nationwide residence-renewal number. For the residence particulars, the authority to confirm with is the exit-entry authority in your place of residence.

The work-permit sequence

Cancellation comes first, and it is the employer's action. After that, the path depends on your case:

  • Beijing, same position, original permit still valid. Beijing's changing-employment guide states that when the position (occupation) does not change and the original work permit is still valid, you cancel the original permit first and then apply for the new one within three months of the cancellation date (Changing Employment guide). As examples of what that application asks for, the same Beijing page lists a contract or employment proof from the new employer, the passport information page, and the information page of a valid work-type residence permit.
  • Other cases. The three-month window is stated in Beijing guidance for that scenario. It is not evidence of a national deadline that applies to every region or every kind of employer change.

Nationwide, the 2024 notice from the Ministry of Human Resources and Social Security moves these procedures online: work permit application, extension, change and cancellation are handled entirely through the Foreigner Work in China Management Service System, and already-issued physical permits transition under an "unchanged, no exchange" principle (MOHRSS Letter [2024] No. 75, published 2024-10-27, effective 2024-12-01). This is why older Beijing-page references to on-site appointments, physical permits or legacy-system links should not be read as the current national process.

The residence side and the reporting duty

Article 26 of the 2025 regulation is the clearest anchor: the employing unit reports to the local exit-entry authority when a hired foreigner leaves the job or changes work region. "Changes work region" is a distinct trigger from a same-city employer swap, and it is exactly the kind of move that can pull your residence particulars out of alignment.

Because residence particulars vary by location and by what is recorded on your permit, the evidence does not let this guide state a uniform step for the residence document. The reliable move is to check with the exit-entry authority in your place of residence whenever the purpose of stay or a recorded item changes.

Where the rules differ by locality and by case

Three variables change the answer you will get:

  1. City. The three-month "cancel then reapply" window comes from Beijing guidance under the stated conditions. Another city's guide may describe a different sequence or no fixed window at all.
  2. Same position or not. Beijing limits its three-month rule to cases where the occupation is unchanged and the original permit is still valid.
  3. Same region or not. A move across work regions adds the Article 26 reporting trigger on top of the permit changes.

Treat any single timing figure you see quoted as local and conditional until the authority in your city confirms it.

Practical reminders, kept separate from the rules

These are working habits, not legal requirements, and they do not replace what the authorities tell you:

  • Confirm the cancellation actually happened. Since the employer files it, ask for the confirmation rather than assuming the old permit is closed.
  • Have the application documents ready. A contract or proof from the new employer, your passport page, and a valid work-type residence permit page are the kind of items Beijing's guide lists — prepare them, but expect your city's list to differ.
  • Don't treat the work permit and residence permit as one renewal. They are tracked separately; close both loops.
