Renewing or Changing a China Residence Permit: When to Contact Exit-Entry Authorities

A practical guide to China residence permit renewal and change: the 30-day and 10-day rules, what counts as a change, how it differs from work permit extension, and which authority handles what.

If your China residence permit needs more time, the national rule is to apply at least 30 days before it expires. If a registered item on the residence permit changes, the national rule is to apply for the change within 10 days. These two deadlines sit in the Exit and Entry Administration Law, and they are the first thing to check before anything else.

The complication is that a residence permit and a work permit are not the same document, and they are not handled by the same authority. Confusing the two is the most common reason people miss a deadline. This article separates them, then covers the sequence, the exceptions, and what varies locally.

The two deadlines that apply nationwide

The Exit and Entry Administration Law sets both.

Extension (延期): Article 32 requires that where the period of residence needs to be extended, the holder apply to the exit-entry administration organ of the public security authority at the place of residence at least 30 days before the residence permit expires. If the extension is not granted, the holder must leave China before the permit expires. (National Immigration Administration)

Change (变更): Article 33 requires that where registered particulars on the residence permit change, the holder apply for the change within 10 days of the date of the change, again at the exit-entry administration organ at the place of residence. (National Immigration Administration)

Both are legal requirements, not suggestions. File by the 30-day-before-expiry point; starting preparation earlier allows time for appointments and materials.

What actually counts as a "change"

Article 33 concerns the particulars registered on the residence permit. The law lists items such as the holder's name, residence purpose and term, and passport or travel-document number. If one of those items changes, ask the local exit-entry authority how to update the permit within the statutory period. An employer change or house move may create other reporting or registration duties, but this source does not make either event, by itself, an Article 33 permit-item change.

Residence permit vs. work permit: two authorities, two processes

This is the part that trips people up.

The residence permit is an immigration document. It is issued and handled by the exit-entry administration of the public security authority (公安机关出入境管理机构). The 30-day and 10-day deadlines above are its rules.

The work permit is a labour and employment document. Since 1 December 2024, under the Ministry of Human Resources and Social Security's integration notice (人社部发〔2024〕75号), work permit applications, extensions, changes and cancellations are handled entirely online through the Foreigners' Work in China Management Service System (外国人来华工作管理服务系统). The same notice states that after December 2024, foreigners entering China no longer need to obtain a physical foreigner's work permit. (Beijing Municipal People's Government, reprinting the notice)

So if your job is continuing with the same employer and the same position, you may need to extend your work permit and extend your residence permit — two applications, two systems, potentially two timelines. Do not assume that completing one covers the other.

The Beijing English-language guide for work permit extension states that where the original employer continues to employ the foreigner in the same position, it is advisable to apply to the decision-making authority at least 30 days before the work permit expires. Note the caveat: that Beijing page is a local operational guide. It still references a physical foreigner's work permit, which predates the 2024 integration notice. Its contract, service-point and appointment details are Beijing-specific and should not be read as the current national process. For the national position on the work permit's information carrier and online workflow, the 2024 notice is the governing document.

The application itself: what to prepare and what you get back

Under the current Regulations on the Administration of Entry and Exit of Foreigners (2025 revision), Article 17 lists the materials for extending, renewing or reissuing a residence permit: an application form, your passport or travel document, photographs, and supporting materials relating to the purpose of your stay. Article 18 provides that where the application meets acceptance requirements, the authority issues a receipt valid for no more than 15 days. During the period your passport is held for processing, you may reside in China lawfully on the strength of that receipt. (Ministry of Justice National Administrative Regulations Database)

That 15-day receipt matters practically: it means handing over your passport does not leave you without status, provided you have the receipt. Keep it with you.

Sequence that works

  1. Check both documents' expiry dates. Residence permit and work permit may run on different cycles.
  2. Identify which event applies. Extension (time running out) or change (particulars changed)? Some situations involve both.
  3. For work permit matters, use the online system and confirm the current process with your employer's HR or the decision-making authority. The 2024 notice governs the national workflow.
  4. For residence permit extension, apply at least 30 days before expiry at the exit-entry authority where you reside.
  5. For residence permit changes, apply within 10 days of the change.
  6. Keep the acceptance receipt. It is your proof of lawful residence while your passport is held.

Where local practice varies, and what to ask

National law sets the deadlines and the material categories. Local exit-entry authorities provide current appointment and service-point details and apply the statutory categories to individual cases. Beijing's work permit guide is an example of local operational detail that may not match another city or the current national system.

If your situation is unusual — a change of employer mid-permit, a new passport with an unexpired permit, a move between cities, or a permit type other than work — the competent authority to ask is the exit-entry administration of the public security authority in the city where you reside. For work permit questions, ask the local authority administering the work permit system; your employer's HR team can coordinate the filing.
