Graduating in China: staying, working, or leaving — what your residence permit actually requires

Does your student residence permit expire on graduation day?

The cited rules do not establish automatic same-day cancellation. The Implementation Regulations instead provide a process under which the issuing authority may declare a permit invalid if the original residence reason changes, the holder fails to report within the prescribed period, and still fails to report after a public announcement (NIA Implementation Regulations, Art. 34). Check your own permit status promptly; its printed expiry date alone may not settle what happens after a change of purpose.

The 10-day rule you cannot miss

Can you stay and job-hunt on a study permit?

Not as a worker. Working in China requires a lawful work permit and a work-type residence permit, and being employed without them is illegal employment (NIA Exit and Entry Law, Arts. 41, 43). A study-type residence permit, and a plan to look for work, are not the same as work authorization. Whether you can remain in the country while a category change is processed, or must leave and apply from abroad, is decided by the residence-place authority on your specific materials (NIA service guide). If you want to work: what the documents look like

The NIA service guide separates the materials for the two permit types. If you leave

Before booking travel, confirm that the document remains valid in your circumstances, especially if your residence purpose has changed. A later job offer does not itself confer permission to work or remain; ask the relevant authority which application route is available.

What goes wrong if you get the category wrong

The law sets penalties, not predictions. Illegal residence can draw a warning, and in serious cases a fine or detention (NIA Exit and Entry Law, Art. 78). Working without the required permit and residence document is illegal employment (NIA Exit and Entry Law, Art. 43).
